The Bak2. com site offers a service for the purchase and resale of Products intended for Professionals. The purpose of these General Terms and Conditions is to define the terms and conditions under which this service, hereinafter referred to as “the Service”, is made available and the conditions of use of the Service by the User. These conditions are valid from 24 April 2018 and apply to all Transactions carried out on the Site from that date. These conditions are included in the email sent to the User after the Product has been registered on the Site.

Any access and/or use of the Bak2. com site and its possible variations implies acceptance of and compliance with all the terms of these Conditions and their unconditional acceptance. They therefore constitute a contract between the Service and the User.

Definitions

* User: refers to any person who uses the Site.

* User Data: refers to the data transmitted by the User in the various sections of the Site.

* Transaction: refers to the purchase, sale or donation of a product by the User to the Company.

* Product: refers to a mobile phone or any other product offered by the Site (Laptop, consoles, etc.).

* Basket: a set of Products selected by the User on the site

* Site: refers to the www.bak2.com site

Terms and conditions of use

The User of the Service must be legally authorised to contract and use this site.

Personal data

The data that the User registers to use the Service will be used by the Company in order to process the User’s request (buy-back, sale, donation) and to inform the User of news relating to the Service. At any time, the User has the right to access, modify, rectify and delete data concerning him/her (art 34 of the French Data Protection Act of 6 January 1978 or its Belgian equivalent www.privacycommission.be). Limits of liability

The Company recommends that Users delete all personal data and SIM cards contained in their Product in the event of donation or repurchase by the Company. The Company undertakes to destroy any SIM cards received and the data on any digital media received. The Company may under no circumstances be held responsible for the loss of personal or professional data contained in the device.

The User acknowledges that he/she is aware of the limitations and constraints specific to the Internet network and, in this respect, recognises in particular the impossibility of a total guarantee of the security of data exchanges.

The Company uses all reasonable means at its disposal to ensure quality access to the Site and the updating of the data contained therein, but is under no obligation to do so. The Company reserves the right to interrupt, temporarily suspend or modify without notice access to all or part of the Site, in order to carry out maintenance, or for any other reason, without the interruption giving rise to any obligation or compensation. During these periods, the Company will remain accessible by telephone or email.

Intellectual property rights

Bak2 Services, Bak2 and its variations are registered trademarks and the property of the Company (or its parent company or a subsidiary). Any unauthorised reproduction of these brands, logos and distinctive signs constitutes an infringement punishable by law. The offender is liable to civil and criminal penalties, in particular the penalties provided for in articles L. 335.2 and L. 343.1 of the French Intellectual Property Code.

Duration and termination

This contract is concluded for an indefinite period from the date of Use of the Service by the User.

Applicable law and jurisdiction

These Terms of Use are governed by and interpreted in accordance with French law.
